The first appearance in administrative set-date court may occur between one and two months after an individual has been arrested and charged with a criminal offence. While a Judge may preside over this hearing it will generally be before a Justice of the Peace. It would be helpful to have hired a criminal lawyer in Toronto by this point to ensure that the case is properly dealt with. Ideally disclosure will be provided to the person who has been charged with a criminal offence. Disclosure is the evidence which the Crown Attorney will be using to prosecute the case. It is possible that disclosure will not be available at the first appearance. It is also possible that only partial disclosure will be provided. In these cases disclosure may be provided at the next appearance or provided to the criminal lawyer in the interim for them to properly review before the next court date.
